Speaking to Kıbrıs Postası, Lawyer Murat Metin Hakkı emphasized that the intervention regarding the Immovable Property Acquisition Law, which has been brought before the Constitutional Court, was essential. The Immovable Property Acquisition Law was challenged in court by ISAD (the Businessmen's Association) and the Real Estate Advisory Platform, which filed a case with the Constitutional Court, requesting revisions to the law. In his comments to Kıbrıs Postası, Hakkı underscored that the law contains several aspects that require intervention and expressed support for the decision to bring the matter to the court.

"THE LAW WAS RUSHED"

Hakkı highlighted the legal uncertainties surrounding the preparation of the Immovable Property Acquisition Law, noting that the process was rushed in many respects. He supported the decision to refer the matter to the Supreme Court as a positive step.

"FINDINGS WILL BE CRUCIAL FOR FUTURE LEGISLATION"

Hakkı emphasized the importance of having various aspects of the law undergo judicial scrutiny. This would allow for the identification of deficiencies, which could be addressed in future legislative efforts. "If there are shortcomings or faults, addressing them will be beneficial," he stated.

KEY ISSUES: CONDOMINIUM AGREEMENTS AND TAX DEADLINES

Hakkı identified several problematic areas within the law, including regulations related to condominium agreements and issues concerning the deadlines for tax payments. He noted that the government had recently revisited these tax deadlines through a Cabinet decision.

Summarizing his views, Hakkı stressed that intervention in this law was crucial, stating, "A step needed to be taken."

"UNCERTAINTIES COULD NEGATIVELY IMPACT THE CONSTRUCTION SECTOR"

Hakkı pointed out that there were uncertain points in the law that could negatively impact not only buyers and sellers but also contractors and foreign investors. These uncertainties could create adverse effects on the construction sector.

"THE OUTCOME WILL SHED LIGHT ON CURRENT AND FUTURE LEGISLATION"

Hakkı concluded by assessing the decision to take the law to the Constitutional Court as "a good step," adding, "I believe the outcome will shed light on the current text and similar future legislative efforts."
