Arıklı: "Decisions Published in the Official Gazette Cannot Be Challenged in Court"
Minister of Public Works and Transport Erhan Arıklı stated that decisions published in the Official Gazette are immune to legal challenges, addressing recent disputes surrounding the Attorney General's opinion after the Parliamentary Speaker election.
Arıklı shared his views on social media, noting that questions from journalists were not entertained during a press briefing held in Parliament and responding to the ongoing debate over seeking the Attorney General's opinion.
Arıklı highlighted a question from journalist Pınar Barut, who asked why an opinion wasn’t sought from the Attorney General. He replied, referencing a statement by Tufan Erhürman in 2020, that the Attorney General’s opinion is not legally binding.
Expressing confidence in the government’s position, Arıklı noted that during an interview with BRT’s Pembe Paşaoğluları, he suggested that Deputy Speaker Fazilet Özdenefe, who is set to act as Speaker tomorrow, could formally seek an opinion from the Attorney General on the matter if desired.
He further explained that a previous consultation with the Attorney General regarding Zorlu Töre was due to a "not elected" annotation in the election records, but with the current process completed and the decision published in the Official Gazette, the situation was distinct.
Arıklı emphasized that decisions in the Official Gazette close off the route to court appeals, adding that a negative opinion from the Attorney General would not be feasible in this scenario.
In conclusion, Arıklı remarked, “The CTP has backed itself into a corner and will find it difficult to escape. Soon, the public may question why Parliament isn't functioning, holding both the government and opposition accountable.”
