BY Files Lawsuit Over Parliamentary Speaker Election
Independence Path (BY) announced that it has filed a "Quo Warranto" lawsuit at the Court of Cassation to challenge the legality of Ziya Öztürkler’s election as the Speaker of Parliament. The announcement was made by Secretary-General Umut Ersoy and lawyer Serkan Mesutoğlu.
Umut Ersoy, representing Independence Path, stated that the lawsuit aims to examine whether the process by which Ziya Öztürkler was elected was in compliance with the law. Lawyer Serkan Mesutoğlu also provided details about the case.

Umut Ersoy, Secretary-General of Independence Path, noted that the political crisis over the parliamentary speaker election has been ongoing for over a month. He emphasized, “Independence Path has repeatedly pointed out from day one that this crisis and the ongoing process are completely disconnected from the real problems of the people, with regime politics consumed by its own agenda.”
Ersoy highlighted that the party has presented political analyses and actions on this issue, and, as part of their bPather struggle, they are now resorting to legal action. He added that this "Quo Warranto" case would mark a first in legal history.
“Our main concern is that the real problems of the people are discussed and solutions are found,” Ersoy said, expressing confidence that the process could be concluded with a legal interpretation.
MESUTOĞLU: THIS LAWSUIT IS A PIONEERING CASE IN THE LEGAL HISTORY OF CYPRIOT TURKS
Serkan Mesutoğlu, the lawyer representing Independence Path in the case, pointed out that the parliamentary speaker election has both a political and legal dimension. He noted that the inability of the parties to reach a legal consensus had led to a political deadlock as well.
Mesutoğlu clarified that the case would not be filed with the Constitutional Court but would be initiated through a "Quo Warranto" petition at the Court of Cassation. He explained that "Quo Warranto" pertains to verifying whether the process through which an individual is appointed or elected to a position has been carried out in accordance with the law.
He further explained that if the court finds that the parliamentary speaker election was conducted illegally, it could declare the position vacant. Mesutoğlu confirmed that Independence Path's request is for the position to be declared legally vacant.
Stating that the "Quo Warranto" lawsuit would be a first in the legal history of the Turkish Cypriots, Mesutoğlu described it as a "pioneering case." He added that regardless of the outcome, this case could serve as an alternative legal route for future cases where laws and regulations are believed to be violated but specific remedies are unavailable.
Mesutoğlu concluded by stating that updates on the legal proceedings would be shared with the public in the coming days.
Following the announcement, the case was filed at the High Court Registry.
